Sturgeon County Kennels Ltd. Client Agreement and Waiver

This Client Agreement and Waiver (Agreement) is between Sturgeon County Kennels Ltd. (SCK, we, us, our) and the undersigned client (you, your). It applies to all boarding, daycare, grooming (if applicable), handling, and related services provided by SCK (Services).

By using our Services, you confirm that the information you provided to us (including pet details, health, behavior, medications, emergency contacts, approved pickup list, and veterinarian information) is accurate and complete.

1. Definitions

Pet means the animal(s) you bring to SCK.

Premises means SCK’s facility, parking areas, and surrounding property.

Released Parties means SCK, its owners, directors, officers, employees, contractors, volunteers, and representatives.

2. Acknowledgement of Risks

You understand and agree that animal care environments involve inherent risks, including but not limited to:

  • bites, scratches, fights, and other animal interactions
  • injury from play, socialization, exercise, handling, or routine kennel activities
  • illness, including communicable diseases that may spread even with vaccination protocols
  • stress-related behavior, escape attempts, and property damage
  • slip and fall or other incidents while on the Premises
  • unpredictable behavior by animals, including your Pet and other animals

You agree to mitigate risks by following safety instructions while on the Premises, including keeping dogs leashed and cats in a secure carrier while moving to and from your vehicle and the kennel area.

3. Release of Liability and Waiver of Claims

To the fullest extent permitted by law, you release and discharge the Released Parties from any and all claims, demands, actions, causes of action, losses, damages, costs, and expenses arising from or relating to the Services, your Pet, or your presence on the Premises, including claims arising from negligence, breach of contract, or breach of any duty of care, except to the extent not legally capable of being waived.

This release applies to claims for injury, illness, death, loss, or property damage suffered by you or your Pet.

4. Indemnity

You agree to indemnify and hold harmless the Released Parties from and against any claims, demands, losses, damages, costs, and expenses (including legal fees on a solicitor and client basis where permitted) arising from or relating to:

  • injury or damage caused by your Pet to any person, animal, or property
  • your breach of this Agreement
  • inaccurate or incomplete information you provided about your Pet, including behavior or medical needs

5. Health, Behavior, and Eligibility

You certify that:

  • your Pet is in good general health and is free of communicable conditions to the best of your knowledge
  • your Pet has not had a communicable disease within the last 90 days, unless disclosed to SCK in writing
  • your Pet has not previously shown aggressive behavior toward animals or humans, unless disclosed to SCK in writing

You understand that SCK may refuse or end Services if your Pet poses a safety risk, including aggression toward animals or humans. If Services are ended early, you remain responsible for all charges incurred to that point, plus any reasonable costs required to keep people and animals safe.

6. Vaccinations and Records

You understand that current vaccination records are required before check in.

Dogs require rabies, DHLPP (or equivalent), and bordetella.

Cats require rabies and FVRCP (FeLV recommended).

If records are not current and received by SCK, SCK may refuse check in or end Services.

7. Medical Authorization and Costs

7.1 Authorization to Provide Routine Care

You authorize SCK to provide routine care, including feeding and administering medications you supply with instructions. You acknowledge SCK staff are not veterinarians and are not trained to perform veterinary medical procedures.

7.2 Emergency Treatment Authorization

If SCK believes your Pet requires veterinary care, you authorize SCK to obtain veterinary treatment for your Pet as reasonably necessary to preserve your Pet’s health and wellbeing.

SCK will attempt to contact you or your emergency contact. If you cannot be reached promptly, you authorize SCK to act in its reasonable discretion in consultation with a veterinarian.

7.3 On Call Veterinarian Choice

Your selection regarding SCK’s on call veterinarian (Yes or No) is captured in the form submission and is incorporated into this Agreement. If urgent care is required and your preferred veterinarian is unavailable, SCK will follow your on call selection, subject to what is reasonably available in the circumstances.

7.4 Responsibility for Costs

You agree you are fully responsible for all costs associated with veterinary care, transportation, medication, or related expenses incurred for your Pet, and you agree to reimburse SCK for any amounts SCK pays on your behalf.

7.5 Release Regarding Medical Care

You release the Released Parties from liability arising from veterinary care decisions made in good faith in an emergency or in circumstances where timely contact is not possible, except to the extent not legally capable of being waived.

8. Communicable Disease Acknowledgement and Communications

You understand that communicable diseases (including kennel cough and other respiratory or gastrointestinal illnesses) can occur in kennel environments even when vaccination requirements and sanitation protocols are in place.

You acknowledge and accept this risk. You agree that SCK’s outbreak communications may be provided by email based on SCK’s Communicable Disease and Outbreak Communication Policy, which is incorporated by reference and may be updated from time to time.

9. Photos and Media

If you provide consent in the form submission, you authorize SCK to photograph or record your Pet and use those images for operational updates and marketing. If you do not consent, SCK will use reasonable efforts to exclude your Pet from marketing content.

10. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Province of Alberta and the laws of Canada applicable in Alberta. Any dispute must be brought exclusively in the courts of Alberta.

11. General

  • This Agreement binds you and your heirs, next of kin, executors, administrators, and representatives.
  • If any part of this Agreement is found unenforceable, the remaining parts remain in effect.
  • This Agreement applies to all future visits unless replaced by a newer version presented by SCK.

Acceptance

By completing the acknowledgement below, you confirm you have read and understood this Agreement and you agree to be bound by it.
